He knew that if he got drunk, when he woke up his tsuris would still be waiting for him. His whole life had been built on a lie by his monstrous father. The devil has presented his due bill to Bernie for his life of luxury - it is not enough that he spend the rest of his life in a prison cell. The price of such monstrous crimes which ruined the lives of many (of his fellow Jews) must be paid in blood. Having fun yet, Bernie?
Civil suits against him by the trustee were just announced. There were rumors of criminal prosecution also - his life as he knew it as a rich Manhattan socialite was over already. His lawyers had also instructed him not to have any contact with his parents from the day his father was arrested, further unmooring him from his life.
My parents were both survival at all costs type personalities but I can see that there are circumstances where suicide is a rational decision. I would not have chosen it personally in this case, but I can see why he saw this as his best option. Perhaps he had incontestable life insurance policies and thought that this was the only way to salvage the lifestyle of his wife and child. The civil suits will continue against his estate but the insurance proceeds probably cannot be reached.
There was a possibility that jail awaited him so it was beyond just money. Still, he was far from convicted (and even if convicted, his father has shown that there is a life, of sorts, to be made in prison - the prisons that they send white collar criminals to are not the worst places on earth). But Bernie had grown up poor so a return to a simple life was not out of the question for him. For the son, who knew nothing but the life of the Upper East Side with doormen and limos, prison was just beyond his imagination. Still, he pulled the plug much too early - he had not even been indicted yet. But it is not unusual for strong fathers to have weak sons.
There is a story that a man saved Mark's life when he was a kid, and in return the grateful Bernie convinced that man to park his $100,000 with him. That's the kind of wierdo Bernie is, a truly pathological case with nothing of the charm of Charles Ponzi about him. As for the investors Bernie defrauded, they should take it as a lesson well-learnt and take a stiff drink. If someone is offering you guaranteed returns way above the market rate, he is upto no good; loan-sharking, pimping, drug dealing or a plain Ponzi scheme are they only few ways to make that kind of return. His 'investors' were operating on a Don't Ask Don't Tell principle. I've seen this phenomena in operation many times in India. The husband sends home money, savvy wife is unhappy with the 9% pa on offer at the banks and instead turns to the moneylenders who in turn are on the prowl for the desperate. When the going is good a return of 36-50% makes everyone happy, except the fellows at the bottom of the pyramid or the last suckers in the case of a Ponzi. Moaning and great gnashing of the teeth, accompany the inevitable collapse.
Mark Madoff, seems to have been a dutiful son. Perhaps the vindictive US justice system (when it comes to commercial crimes), got to him. The prosecutors must have scared him with visions of a shared prison cell with some 300 pound male named Jane. Something has to be done about the cruelty of a prison system, that doubly punishes the prisoner by unleasing the dregs of mankind upon them.
Madoff Sr. did apparently get beaten by a fellow prisoners at some point, but in general the prison he is in seems to be a tolerable place (as prisons go) and not the hellhole of homosexual rape that you imagine.
My experience with prisons is limited to guarding the Ketziot camp in military service and the prisioners ate the same or better food than we were getting, they had the same cloths and matresses and so on. They couldnt get out but we could neither. Their punishment was having to live in close contact with people like themselves, and our privilege was to be able to live and work with people like ourselves. It is an unusual punishment to having to share a tent with analphabet agitated "goat-rapers", even for "goat-rapers".
At a federal minimum security prison you get to meet a "better" class of criminal - doctors and pharmacists who issued too many prescriptions for painkillers, stock fraudsters, senior Mafia members (not street thugs but sophisticated businessmen), etc.
If so, he is in good company. He could found a Torah study group and become a scholar. It is very common in Israeli prisons. In fact, Israeli prisons are very liberal, there are paid vacations and marital visits of any kind. That's why there is almost no rape in Israeli prisons. There is a drug problem.
There are a few Jews but he would be hard pressed to round up a minyan. Prisons are one sphere where Jews are underrepresented (professional sports is another).
